Delivery Pass: Terms and Conditions

These terms and conditions together with our website Terms of Use, Terms and Conditions of Sale and Privacy Policy apply to any Delivery Pass membership that you may purchase from our website groceries.morrisons.com or through our mobile app, Morrisons Grocery.

Any reference within these terms and conditions to our website also includes reference to our mobile app.

Please read all of these terms and conditions carefully before you purchase a Delivery Pass membership because by purchasing a Delivery Pass membership you agree to be bound by them.

If you do not accept these terms and conditions, you should not purchase a Delivery Pass membership from us.

You should print and save a copy of these terms and conditions for your future reference.

Purchase of a Delivery Pass membership

Delivery Pass memberships are only available to customers aged 18 years or over who have a valid account on our website and not to anyone operating as or on behalf of any business or for the purpose of business use or resale of any products purchased from our website.

We reserve the right to accept or refuse any purchase of a Delivery Pass membership at our discretion.

These terms and conditions will become binding on you and us when we issue you with a confirmation email of your purchase of a Delivery Pass membership, at which point a contract will come into existence between you and us. Your Delivery Pass membership will be valid from the date of our confirmation email to you.

Payment for membership may be taken after we have issued our confirmation email to you. If payment is declined or otherwise unauthorised by your bank then we reserve the right to suspend your membership until such time as any outstanding fee is paid to us in full. In such circumstances you will not be entitled to a refund of any part of the membership fee or an extension of your membership term. Any deliveries ordered during your suspension will be charged in accordance with the delivery charges displayed on our website.

Each Delivery Pass membership and the benefits of such membership must only be used by the named account holder and may not be transferred or assigned to any other person.

The Delivery Pass membership fee is the fee displayed on our website. This fee is non-refundable except as expressly set out in these terms and conditions.

There are different types of Delivery Pass membership available. Please check the details and minimum term of each type of membership on our website prior to purchase. Once purchased you will not be able to swap to a different membership during the minimum term.

Orders placed on our website but not delivered prior to your membership being activated will be subject to our delivery charges as displayed on our website.

If you purchase your Delivery Pass membership after we have released priority access to Christmas delivery slots for Delivery Pass members in accordance with clause 2.4 then you will not be entitled to priority access for Christmas delivery slots.

In order to benefit from free deliveries under the Delivery Pass you must have a valid account on our website and must update your contact and delivery details if there are any changes to these during your membership.

Delivery Pass membership benefits

Your Delivery Pass membership entitles you to a maximum of one free delivery of goods purchased from our website per day during the term of your membership on the days and times determined by the type of membership purchased by you. Please see our Terms and Conditions of Sale for further terms relating to delivery.

Your Delivery Pass membership does not guarantee a delivery slot.

If any delivery slots you reserve are not included in your type of Delivery Pass membership or if you arrange more than one delivery in any one day then you will be charged for those deliveries by us in accordance with the delivery charges displayed on our website.

Our Christmas delivery period is from 20 December to 24 December inclusive. During this time you are entitled to a maximum of two free deliveries of goods purchased from our website, of which no more than one may be booked for delivery during the period 23 - 24 December. You will not be guaranteed a delivery slot during this time but will be given priority access to book deliveries before they are released generally to the public.

Purchase of a Delivery Pass membership does not:

2.5.1 - commit you to purchasing any minimum amount of products on our website or restrict your purchase of products from our website in any way (subject to our Terms and Conditions of Sale);

2.5.2 - commit you to receiving any minimum number of deliveries from us; or

2.5.3 - guarantee that any products on our website will be in stock at any time.


Cancellation of your Delivery Pass membership

You have the right to change your mind and cancel your Delivery Pass membership within 14 days of our email to you confirming your membership provided you have not used your Delivery Pass membership in that time.

If you decide to cancel your Delivery Pass membership under clause 3.1 you must do so by notifying our Customer Services team in writing including your name, address and postcode, contact telephone number and Delivery Pass membership number. Your Delivery Pass membership will then be cancelled and we will issue you with a refund for the price paid for your membership to the account from which your membership fee was paid. If your membership was purchased in conjunction with a special offer we will issue you with a refund equal to the cost of the membership less the value of the special offer voucher redeemed.

It is within our absolute discretion to agree to cancel any Delivery Pass membership once the Delivery Pass has been used or, if not, after 14 days of purchase. If you wish to cancel a Delivery Pass membership in these circumstances please contact our Customer Services team.

If your Delivery Pass membership is part of a free trial and you wish to cancel your trial membership please contact our Customer Services team before the end of the free trial.

We reserve the right to monitor usage of your membership and to terminate your membership in our absolute discretion by giving notice to you if we believe that there has been a breach of any clause of these terms and conditions including but not limited to fraudulent or other misuse of your Delivery Pass membership. If your membership is terminated in accordance with this clause no refund will be given in respect of the terminated membership.

Changes to Delivery Pass membership benefits and fees

We reserve the right to change any Delivery Pass membership fees and/or benefits (or any element of them) at any time and we will contact you by email to give you at least 28 days’ notice of any such change. Any such changes will also be updated on our website. Such changes will not take effect until the next renewal date following our email confirmation to you.

If you do not wish to continue your membership following any such change as described in clause 4.1 then you may cancel your Delivery Pass membership with effect from the next renewal date by contacting our Customer Services team no less than 7 days before the relevant renewal date.

Unless you contact our Customer Services team in writing not less than 7 days before your renewal date to cancel your Delivery Pass membership we shall be entitled to interpret your lack of contact as your acceptance of these changes. We will not be liable for any losses resulting from any changes to, or termination or withdrawal of, any Delivery Pass membership benefits or changes to Delivery Pass membership fees.

Renewal of your Delivery Pass membership

The renewal date will be automatically calculated from the date that your Delivery Pass membership is activated. Where an activation date is the 29th, 30th or 31st of the month when the month of the renewal does not contain that corresponding date, the Delivery Pass membership renewal date shall be taken to be the last day in that month.

Any change in Delivery Pass membership fee under clause 4.1 shall take effect on the next applicable renewal date.

If you are a monthly Delivery Pass member your membership will automatically renew, and payment will be taken from the account used to purchase your Delivery Pass membership for the current monthly fee, each month on or around the renewal date unless you notify our Customer Services team in writing not less than 7 days before the renewal date that you wish to cancel your Delivery Pass membership.

If you have purchased a six or twelve month Delivery Pass membership we will contact you using the email address provided by you to remind you of the renewal date of your Delivery Pass membership 28 days beforehand, including details of the renewal price. Your Delivery Pass membership will be automatically renewed on the renewal date and payment for such renewal in the amount specified in your renewal email will be taken from the account used to purchase your Delivery Pass membership on or around the renewal date unless you notify our Customer Services team in writing not less than 7 days before the renewal date that you wish to cancel your Delivery Pass membership.

If you contact us to cancel your Delivery Pass membership with less than 7 days’ notice before your renewal date then your membership will automatically renew on the renewal date and payment will be taken from your account.

If we are unable to take payment in accordance with clauses 5.3, 5.4 or 5.5 either if payment is declined or otherwise unauthorised by your bank and no other payment method has been provided then we reserve the right to suspend your membership until such time as any outstanding fee is paid to us in full. In such circumstances you will not be entitled to a refund of any part of the membership fee or an extension of your membership term. Any deliveries ordered during your suspension will be charged in accordance with the delivery charges displayed on our website. For the avoidance of doubt in these circumstances your Delivery Pass membership shall still be automatically renewed and payment for the renewal will be due and owing to us by you.

If your Delivery Pass membership is suspended in accordance with clause 1.4 the renewal date of your membership will remain the date provided in your initial confirmation email.

General

By purchasing a Delivery Pass membership you consent to receiving emails from us providing information about the Delivery Pass and your use of it. If you would prefer not to receive such emails please contact our Customer Services team.

Any delay or failure to enforce compliance of these terms and conditions shall not constitute a waiver of any of our rights.

We revise our terms and conditions from time to time. You should regularly check for changes we make, the latest revision date is provided at the end of these terms. If you do not agree with them, you should stop using our website.

If we fail to comply with these terms and conditions, we shall only be liable to you for the purchase price of the products and other losses that you suffer as a result of our failure to comply which are a foreseeable consequence of such failure.

Nothing in these terms and conditions excludes or limits our liability for:

6.5.1 death or personal injury caused by our negligence;

6.5.2 fraud or fraudulent misrepresentation;

6.5.3 any breach of the obligations implied by section 12 of the Sale of Goods Act 1979; or

6.5.4 any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

Neither we nor you will be responsible if we are unable to perform our obligations under these terms and conditions due to events which are genuinely beyond your or our reasonable control (as applicable).

If any of these terms and conditions shall be deemed invalid, void, or for any reason unenforceable, they shall be deemed severable and shall not affect the validity and enforceability of any remaining terms and conditions.

Nothing under these terms and conditions shall give rights to any person who is not a party to them (whether under the Contracts (Rights of Third Parties) Act 1999) or otherwise.

As far as is legally possible, all aspects of the contract formed in respect of your Delivery Pass membership shall be governed by English law and the parties agree to the non-exclusive jurisdiction of the English courts. In some circumstances the laws where you are domiciled may apply and the courts where you are domiciled may have jurisdiction.
